Official Rules

How to Enter: No purchase necessary. The entry period of the Taylor Made Golf Canada Ltd. (“TaylorMade”) TAYLORMADE Professional Championship Giveaway ("Contest") runs from 12:00 p.m. EST on May 18^th, 2023 until 11:59:59 p.m. EST on May 21^st, 2023 (“Entry Period”). To enter this Contest, users must read and accept the OFFICIAL CONTEST RULES (“Official Rules”), you must follow @TaylorMade_ca (Instagram) or @taylormadeca (Twitter, Facebook) and tag 3 friends in the comments The Contest is in no way sponsored, endorsed or administered by, or associated with Instagram, Facebook or Twitter (the “Social Platforms”). The Social Platforms are hereby completely released of all liability by each entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not to the Social Platforms. You may only use one (1) Instagram, Facebook, Twitter (the “Accounts”) to participate in this Contest.

ELIGIBILITY: To enter and be eligible to win, a person must be a resident of Canada and over the age of majority in his/her province/territory. TaylorMade (the "Sponsor”) and its employees, parent and affiliate companies, their representatives and agents, as well as immediate family members (sponsors, parents, siblings, and children) and the persons with whom they are domiciled are not eligible to enter this Contest.

PRIZE: There will be one (1) prize allocated to one (1) winner from all eligible entries into the contest across Canada. The prize pool consists of one (1) PROFESSIONAL CHAMPIONSHIP STAFF BAG.(all prizes included have an approximate value of $799.99).

DRAW AND ODDS: All participants who are enter prior to the end of the contest period will be entered into a random draw that will take place on May 22^nd (“Random Draw Date”) at 12pm in Woodbridge, Ontario to select the potential winners. The odds of being selected as a potential winner of the Prize depends on the number of entries received during the Contest Period.

AWARDING THE PRIZE: Attempts to notify potential winners will be made using Instagram accounts provided at entry. TaylorMade will direct message winners within 2 weeks after the draw. Sponsor is not responsible for phone, e-mail or other communication problems of any kind. If, despite reasonable efforts, a potential winner does not respond within 4 days of the first notification attempt (or such shorter time as exigencies may require), or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected.

Before being declared a winner, entrant must (1) correctly answer, without assistance of any kind, whether mechanical or otherwise, the mathematical skill-testing question posed by TaylorMade and (2) sign an agreement provided in email by TaylorMade confirming compliance with the Official Contest Rules, acceptance of the Prize as awarded and releasing the Sponsor, TaylorMade of any liability in connection with the Contest or any Prize. Such response by selected entrant must be signed when prize is received.

In the event that the selected entrant cannot be reached and has not responded within 4 days of the Random Draw Date, or if the selected entrant does not correctly answer the mathematical skill-testing question or the selected entrant does not completed the requested information or the selected entrant is otherwise ineligible, another entrant will be randomly selected and the process above will be repeated until such time as a winner is declared or May 31^st, 2023. If by 11:59 pm EST on May 31^st, 2023, no winner has been declared, then the Contest will be closed and no further Prizes will be awarded. Confirmed Winners must claim their prize no later than June 1^st, 2023, failing which, the Winner will be disqualified, will have forfeited their prize, and will have no claim to any prize nor any recourse towards the Sponsor, or any party involved in the Contest and the Prize will not be awarded.

Prize is non-exchangeable, non-refundable, has no cash surrender value and must be accepted as awarded with no substitutions. The Contest Sponsor reserves the right, in their sole discretion, to substitute and/or modify a prize with (a) prize(s) of equal or greater value for any reason. Should a winner be unable to claim his/her prize or prize portion as awarded, his/her rights to that prize or prize portion will be forfeited. All Entries are subject to verification. TaylorMade reserves the right, in its sole discretion, to require proof of identity and/or eligibility (in a form acceptable to TaylorMade) to participate in this Contest. Failure to provide such proof in a timely manner may result in disqualification. The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s).

The Contest Sponsor makes no representation nor offers any warranty, express or implied, as to the quality or fitness of any prize awarded in connection with the Contest. Prize winners understand and acknowledge that he or she may not seek reimbursement or pursue any legal or equitable remedy from the Contest Sponsors should a prize fail to be fit for its purpose or is in any way unsatisfactory to a prize winner.

GENERAL RULES: By entering this Contest, each entrant agrees to abide by the Official Contest Rules and the decisions of the Sponsor with respect to all aspects of the Contest, which are final. To the extent permitted by law, the Sponsor accepts no responsibility for loss, damage or claims caused by or resulting from the Contest and/or the Prizes. Without limiting the foregoing, the Sponsor will not be responsible for late, lost, illegible, falsified, or incomplete entries and all such forms are void. By entering, each entrant consents to the use of his/her name, address (city and province/territory) and/or photograph without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsor in connection with this Contest. All decisions of the Sponsor shall be final. All entries become the permanent property of the Sponsor and shall not be returned. The Contest is subject to all applicable Federal, Provincial and Municipal laws.

By entering this Contest, each entrant expressly consents to the Sponsor, their agents and/or representatives, storing, sharing and using the personal information submitted with his/her entry only for the purpose of administering this Contest and in accordance with the TaylorMade’s Privacy Policy (available at: www.taylormadegolf.ca), unless the entrant otherwise agrees.

In the event of any discrepancy or inconsistency between the terms and conditions of these English Official Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, registration and/or point of sale, television, print or online advertising and the French Official Rules; the terms and conditions of these English Official Rules shall prevail, govern and control.

JURISDICTION: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules or the rights and obligations of entrants and Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the Province of Ontario without giving effect to any choice of law or conflict of laws rules or provisions. All entrants outside of the Province of Quebec consent to the jurisdiction and venue of the Province of Ontario for any legal claims arising from or relating to the Promotion or these Official Rules.

In Quebec, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

PRIVACY: By entering this Contest, all entrants consent to the use of their email addresses, names, city of residence, and/or photograph for publicity purposes in all media related to this Contest used by the Sponsor, without payment or compensation. Entrants agree to Sponsors’ use of the entrants' personal information as described in Taylor Made Golf’s Privacy Policy located at http://taylormadegolf.ca/privacy/privacy,en_CA,pg.html

The Contest Parties, excluding the Sponsor, are not responsible or liable for any personal information collected during this Contest and are not administrators of this Contest.

RÈGLES OFFICIELLES

COMMENT PARTICIPER : Aucun achat requis. La période d’inscription au Concours Professional Championship TaylorMade 2023 (le « Concours ») de TaylorMade Golf Canada Ltd. (« TaylorMade ») se tiendra à partir de midi HNE le 18 mai 2023 jusqu’à 23:59:59 HAE le 21 mai 2023 (la « période d’inscription »). Pour participer à ce concours, les utilisateurs doivent lire et accepter les RÈGLES OFFICIELLES DU CONCOURS (les « Règles officielles »), suivre@TaylorMade_ca (Instagram) ou taylormadeca (Twitter, Facebook) et identifier 3 amis dans vos commentaires. Le Concours n’est d’aucune façon commandité, parrainé ou administré par Instagram, Facebook ou Twitter (les « Plateformes sociales »). Les Plateformes sociales sont par la présente exonérées de toute responsabilité par chaque participant dans le cadre du Concours. Toute question, tout commentaire ou toute plainte en rapport avec le Concours doit parvenir au Commanditaire et non aux Plateformes sociales. Vous ne pouvez utiliser qu’un (1) compte Instagram, Facebook ou Twitter (les « Comptes ») pour participer au Concours.

ADMISSIBILITÉ : Pour s’inscrire et être admissible à gagner, il faut être un résident du Canada et avoir l’âge de la majorité dans sa province ou son territoire de résidence. TaylorMade (le « Commanditaire ») et ses employés, la société mère et les sociétés du même groupe, leurs représentants et mandataires, ainsi que les membres de la famille immédiate (commanditaires, parents, fratrie et enfants) et les personnes avec qui ils sont domiciliés, ne sont pas admissibles au présent Concours.

PRIX: Un (1) prix sera décerné à un (1) gagnant parmi toutes les inscriptions admissibles dans le cadre du Concours à travers le Canada. Le prix à gagner consiste en un (1) sac Professional Championship (au total, les prix ont une valeur approximative de 799,99$).

TIRAGE ET CHANCES DE GAGNER : Tous les participants inscrits avant la fin de la période d’inscription seront inscrits à un tirage au sort qui aura lieu le 22 mai 2023 (« Date du tirage au sort »), à midi à Woodbridge en Ontario pour sélectionner les gagnants potentiels. Les chances d’être sélectionné comme gagnant potentiel du Prix dépendent du nombre d’inscriptions reçues pendant la période du Concours.

OCTROI DES PRIX : Des tentatives seront faites pour rejoindre les gagnants potentiels via les comptes Twitter ou Instagram fournis lors de l’inscription. TaylorMade fera parvenir un message aux gagnants dans les 2 semaines suivant la date du tirage. Le Commanditaire n’est pas responsable des problèmes de communication par téléphone, courriel ou autres, quels qu’ils soient. Si, malgré des efforts raisonnables, un gagnant potentiel ne répond pas dans les 4 jours de la première tentative d’avis (ou plus rapidement, selon les exigences), ou si le prix ou l’avis de prix est renvoyé sans être réclamé ou sans pouvoir être livré à ce gagnant potentiel, le gagnant potentiel perdra son prix et un autre gagnant pourra être sélectionné.

Avant d’être déclaré gagnant, le participant doit (1) répondre correctement, sans aucune aide, mécanique ou autre, à la question réglementaire d’arithmétique posée par TaylorMade, et (2) signer une entente envoyée par courriel par TaylorMade, confirmant le respect des Règles officielles du Concours et l’acceptation du prix comme il est décerné, et dégageant le Commanditaire des prix, TaylorMade, de toute responsabilité en ce qui concerne le Concours ou tout prix. Cette déclaration par le participant sélectionné doit être signée lorsque le prix est reçu.

Advenant que le participant sélectionné ne puisse pas être rejoint et n’ait pas répondu dans les 4 jours de la date du tirage au sort, ou que le participant sélectionné ne réponde pas correctement à la question réglementaire d’arithmétique ou n’ait pas donné les renseignements demandés ou soit autrement inadmissible, un autre participant sera choisi au hasard et le processus ci-dessus sera répété jusqu’à ce qu’un gagnant soit déclaré, ou jusqu’au 31 mai 2023. Si, à 23 h 59 HNE, le31 mai 2023, aucun gagnant n’a été déclaré, le Concours sera alors clos et aucun autre Prix ne sera attribué. Les gagnants confirmés doivent réclamer leur prix au plus tard le 1^er juin 2023, autrement le gagnant sera disqualifié, aura perdu son prix et n’aura aucun droit sur tout prix ni aucun recours à l’encontre du Commanditaire ou de toute partie participant au Concours, et le prix ne sera pas décerné.

Le prix n’est ni échangeable, ni remboursable, n’a aucune valeur de rachat et doit être accepté comme il est décerné sans aucune substitution. Le Commanditaire du Concours se réserve le droit, à son entière discrétion, de modifier ou de remplacer le prix par un prix de valeur égale ou supérieure, pour quelque motif que ce soit. Si le gagnant ne peut pas réclamer son prix, en tout ou en partie, qui lui a été décerné, il perdra son droit sur le prix, en tout ou en partie. Toutes les inscriptions font l’objet de vérification. TaylorMade se réserve le droit, à son entière discrétion, d’exiger une preuve d’identité et/ou d’admissibilité (dans la forme acceptable à TaylorMade) afin de participer au présent Concours. À défaut de fournir cette preuve en temps et lieu, la personne sera disqualifiée. La détermination du temps, aux fins d’une participation valide au présent Concours, ne se fera qu’avec le ou les serveurs du Concours.

Le Commanditaire du Concours ne fait aucune déclaration et n’offre aucune garantie, expresse ou implicite, quant à la qualité ou à l’adaptation de tout prix accordé en relation avec le présent Concours. Les gagnants du prix comprennent et reconnaissent qu’ils ne peuvent ni demander le remboursement ni exercer de recours en droit ou en équité auprès des Commanditaires du Concours, si un prix ne répond pas à son objectif ou s’il est, de quelque manière que ce soit, insatisfaisant pour le gagnant du prix.

RÈGLES GÉNÉRALES : En participant au Concours, chaque participant convient de respecter les Règles officielles du Concours et les décisions du Commanditaire sur tous les aspects du Concours, lesquelles sont sans appel. Dans la mesure permise par la loi, le Commanditaire n’accepte aucune responsabilité pour les pertes, les dommages ou les réclamations causés par le Concours ou les prix, ou en découlant. Sans limiter ce qui précède, le Commanditaire ne saurait être responsable de toute inscription tardive, perdue, illisible, falsifiée ou incomplète, et tous ces bulletins seront considérés nuls. En s’inscrivant, chaque participant consent à l’utilisation de son nom, de son adresse (ville et province) ou de sa photo, ou de tous ces éléments, sans aucune rémunération en relation avec toute publicité réalisée par le Commanditaire ou en son nom, en relation avec le présent Concours. Toutes les décisions du Commanditaire sont sans appel. Toutes les inscriptions deviennent la propriété permanente du Commanditaire et ne seront pas retournées. Le Concours est assujetti à toutes les lois applicables de nature fédérale, provinciale et municipale.

En participant au présent concours, chaque participant consent expressément à ce que le Commanditaire, ses mandataires ou ses représentants conservent, partagent ou utilisent les renseignements personnels soumis avec son inscription seulement aux fins de l’administration du présent Concours et conformément à la politique sur la protection de la vie privée de TaylorMade(disponible à l’adresse suivante : www.taylormadegolf.ca), à moins que le participant n’en convienne autrement.

Advenant toute différence ou incohérence entre les conditions des présentes Règles officielles et les divulgations ou autres déclarations contenues dans la documentation liée au Concours, y compris mais sans s’y limiter, l’enregistrement ou la publicité faite aux points de vente, à la télévision, dans la presse écrite ou en ligne, les modalités des Règles officielles prévaudront, régiront et auront préséance.

JURIDICTION: Toutes les questions relatives à la rédaction, la validité, l'interprétation et la force exécutoire de ces Règles officielles ou les droits et obligations des participants et du Commanditaire dans le cadre de la promotion doivent être régies et interprétées conformément aux lois de la province de l'Ontario, sans donner effet à aucun principe de droit ou de conflit de règles ou de dispositions législatives. Tous les participants à l'extérieur de la province de Québec consentent à la juridiction de la province de l'Ontario pour tout différend découlant de, ou lié à la promotion du présent Concours ou de ces Règles officielles.

Au Québec, un différend quant à l'organisation ou à la tenue d'un concours publicitaire peut être soumis à la Régie des alcools, des courses et des jeux afin qu'il soit tranché. Un différend quant à l'attribution d'un prix peut être soumis à la Régie uniquement aux fins d'une intervention pour tenter de le régler.

POLITIQUE SUR LA PROTECTION DE LA VIE PRIVÉE : En participant au présent Concours, tous les participants consentent à l’utilisation de leur adresse courriel, nom, ville de résidence ou photo, ou de tous ces éléments, à des fins publicitaires dans tous les médias utilisés par le Commanditaire en relation avec le présent Concours, sans paiement ni dédommagement.
